July 2019) Conflict of interest - Where a firm acts for a client in a litigious - matter and then seeks to act against that client in a later unrelated litigious matter, that firm may face a conflict of interest because of the possible misuse of confidential information, especially getting to know you factors obtained by it in the previous retainer, and on the basis of the administration of justice ground -- Wills & Estates -(Rule 27) (R4955 ? May 2019) Lawyer as material witness - The potential for a firm to become conflicted by being called as a material witness in proceedings will be avoided where the individual lawyers with the conduct of the matter in question have resigned from employment with that firm prior to proceedings being instigated.
