July 2012) A practitioner may continue to act against a former client in a family law matter where the matter of the former client involved a real estate transaction and the practitioner was not in control of nor had possession of the file (as the practitioner had purchased the practice from the solicitor who had the actual conduct of the real estate transaction) -- Commercial - Conflict of interest (R4771 ? August 2012) A firm should not continue to act in a situation where it has previously acted for a former client and is now acting against the former client in circumstances where, although the current matter is unrelated to the prior matter, there was a very short time frame between acting for and against the former client and there was a dispute between the firm and the client about payment of the firm?s costs.
