The high Court in Ebner v The Official Trustee in Bankruptcy and Clanae v Australia and New Zealand Banking Group has affirmed the apprehension of bias rule in Australia, but in the process has illustrated that such an apprehension might not exist even where a judge owns shares in a litigant corporation.
