Over the past 5 years the Victorian WorkCover Authority (VWA) has actively pursued recovery of compensation payments made by injured workers from negligent third parties pursuant to s 138 of the Accident Compensation Act 1985. In this case the High Court considered whether an action for such statutory indemnity could be classifed as a debt or damages claim pursuant to s 60 of the Supreme Court Act 1986 and therefore entitle the VWA to interest on the claim
