The article looks at whether drafters of affidavits of documents, are obliged to provide particulars of documents, for which privilege is claimed to enable that claim to be tested. The growing body of case law on this issue is equivocal and inconsistent and there apprears to date to be no authority on point binding on a judge of the Victorian Supreme Court. Topics include obligations under 0.29.04, additional obligation, English authorities and Australian authorities. ; The feature incorporates a separate summary on documentary disclosure under order 34A in the County Court, a summary of submission by the LIV and Bar Councils.
