May 2012) In circumstances where a solicitor leaves her or his employment at a firm and commences employment at another firm, all deeds and client files held in safe keeping by that solicitor require client authority for their transfer from the solicitor?s former firm to the safe custody of the solicitor?s current firm -- Wills and estates - Conflict of interest (R4759 ? May 2012) A law practice may not continue to act for the executor of a deceased estate when it has previously acted for the estranged wife of the deceased who is disputing the beneficial entitlement to an asset of the deceased estate and claiming to be a creditor of the deceased estate, and when it has also previously acted for the deceased in respect of his wills. This is based on a consideration of the duty of loyalty and the reasonable observer test
