The Confiscation Act 1997 will replace the Crimes (Confiscation of Profits) Act 1986, resulting in a more aggressive asset confiscation regime in Victoria. Features of the new act are discussed including forfeiture offences, automatic and civil forfeiture offences, restraining orders, embargo notices, and continuing criminal enterprise offenders.
