Notes:
The High Court's decision in Hill v Van Erp means that a legal practitioner retained to prepare a will and attend to its execution owes a duty of care to an intended beneficiary under the will. Failure to preform this duty will expose the legal practitioner to claims by disappointed intended beneficiaries, as well as by the estate of the deceased client.
