Legal practice management - Rule 7.2 - (R4791 ? December 2012) If a solicitor is proposing to destroy hard copy documents in a client?s matter file after scanning the entire file into electronic form, the solicitor should first obtain client consent. Otherwise, the solicitor will be in breach of Rule 7.2 of the Professional Conduct and Practice Rules 2005 if the solicitor only keeps a scanned copy and destroys the hard copy file. Commercial - Conflict of interest - (R4792 ? December 2012) Rule 17.1 of the Professional Conduct & Practice Rules 2005 provides that a practitioner must not advise or suggest to a witness that false or misleading evidence should be given, nor condone another person doing so. In the context of a client at a ?without prejudice? mediation making an admission as to certain action taken by the client, a practitioner who hears the admission may not be precluded from acting or be in breach of Rule 17.1 by disputing the characterisation attributed to the client?s action by the opposing party.
